Terms of Service

1. Acceptance of terms

By creating an account or using Foliole (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Foliole.

2. Description of service

Foliole is a lead management and follow-up tool designed for small service businesses. It provides a public intake page, lead tracking, follow-up reminders, appointment scheduling, and related features.

3. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to create an account.
  • One person or business entity may not maintain more than one free account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable use

You agree not to use Foliole to:

  • Send spam, unsolicited messages, or harass individuals.
  • Collect information without the consent of the people you contact.
  • Violate any applicable law or regulation, including privacy laws.
  • Attempt to reverse-engineer, scrape, or gain unauthorized access to our systems.
  • Impersonate another person or business.

5. Compliance with US law

By using Foliole to send emails or SMS messages to your leads, you agree to comply with all applicable US federal and state laws governing electronic communications, including:

  • CAN-SPAM Act (15 U.S.C. § 7701): You must not use Foliole to send deceptive or misleading commercial email. All emails must identify the sender accurately and include a working opt-out mechanism. You must honor opt-out requests within 10 business days.
  • TCPA (Telephone Consumer Protection Act, 47 U.S.C. § 227): You must obtain prior express written consent from recipients before sending marketing SMS messages through Foliole. You are solely responsible for obtaining and documenting that consent.
  • CCPA / CPRA (California): If you collect personal information from California residents via your Foliole intake page, you may have independent obligations under California privacy law. You are responsible for your own compliance as a data controller for your leads.
  • ECPA (Electronic Communications Privacy Act, 18 U.S.C. § 2510): You may not use Foliole to intercept, monitor, or access communications without lawful authority and appropriate consent.

Foliole provides tools for communication but is not responsible for how you use those tools. You indemnify Foliole against any claims arising from your failure to comply with applicable law.

6. Subscriptions and billing

  • Foliole offers a Free plan and paid Pro plans (Monthly and Annual).
  • Paid subscriptions are billed in advance and are non-refundable except where required by law.
  • You may cancel your subscription at any time through the billing portal. Access continues until the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice.
  • Payment is processed by Stripe. By subscribing, you agree to Stripe's terms of service.

7. Your data

You retain ownership of all data you or your clients submit to Foliole. By using the Service, you grant us a limited license to store, process, and transmit your data solely as necessary to provide the Service. We will not use your client data for our own marketing purposes.

8. Intellectual property

Foliole and its original content, features, and functionality are owned by Foliole and are protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from our platform without prior written permission.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, Foliole shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the three months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases. You may export your data before termination; we will delete your data within 30 days of account closure.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in California.

13. Changes to these terms

We may update these Terms from time to time. We will notify you by email or by posting a notice on the Service at least 14 days before significant changes take effect. Continued use after the effective date constitutes acceptance.
